Thank you for accessing aramax.org (Site). The Site is owned and operated by "Arssi Alliance" LLC. This Terms of Use Agreement ("Agreement") sets forth the agreement between "Arssi Alliance" LLC (hereinafter, "Arssi Alliance", "we", or "us"), and each user ("user", "your" or "you").

This Agreement governs your use of the Site, the Arssi Alliance Autoship & Save Program ("Autoship & Save"), the Arssi Alliance Reviews Program ("Reviews Program"), and the "Arssi Alliance" Privacy Policy ("Privacy Policy").

Please read these Terms of Use carefully before you start to use the Site or participate in the Reviews Program or Autoship & Save, or disclose to us any personal information.

By using the Site or disclosing to us any personal information, you confirm that you accept these Terms of Use and that you agree to comply with them, you accept and agree to be bound by the terms of this Agreement, and you accept and agree to abide by all laws and regulations applicable to the subject matter of this Agreement.

If you do not agree to these Terms of Use, you must not use the Site.

Please note that we keep these Terms of Use updated and we amend them from time to time, so remember to check back in before you use the Website, as the latest set will apply. You should visit this page from time to time to review then current terms of use because they are binding on you. Your continued use of the Site and/or Participation in the Reviews Program, and or Autoship & Save means that you accept any changes or modifications to this Agreement. If any modification is unacceptable to you, your only recourse is to terminate this Agreement by contacting us. Certain provisions of the terms contained in this Agreement may be superseded by legal notices or terms located on particular pages of the Site, or through specific programs terms for the Reviews Program, and Autoship & Save.

The Site does not provide medical advice, diagnosis or treatment, and the information included on the Site is offered for informational purposes only.

Please consult with your physician or other healthcare provider if you have health-related questions before using any of our products or relying on any information you obtain on the Site. You should discuss any medications or nutritional supplements you are using with a healthcare provider before using any new medications or supplements.

Information provided on the Site and linked websites, including information relating to medical and health conditions, treatments and products may be provided in summary form. Information on the Site including any product label or packaging should not be considered as a substitute for advice from a healthcare professional. The Site does not recommend self-management of health issues. Information on the Site is not comprehensive and does not cover all diseases, ailments, physical conditions or their treatment. Product ratings by any current or previous employees or Site users are strictly their own personal views made in their own personal capacity and are not intended as a substitute for appropriate medical care or advice from a healthcare professional. We are not liable for any information provided on the Site with regard to recommendations regarding supplements for any health purposes.

Always check the product label or packaging prior to using any product. If there are discrepancies, customers should follow the information provided on the product label or packaging. You should contact the manufacturer directly for clarification as to product labeling and packaging details and recommended use.

To the extent you make purchases on the Site, you agree that all purchases of products are made pursuant to the respective INCOTERMS designated upon order placement. Title for any products purchased by you will transfer upon our delivery to the carrier.

You are considered the importer of record for all shipments from us, and must comply with all applicable local, state, federal, and international laws and regulations of the country of destination and all laws.

You agree to pay any fees, fines, or other costs charged to us or to you in connection with any non-compliance with laws and regulations of the country of destination.

Arssi Alliance has the right to cancel or refuse the orders from the countries for which RA has export prohibition.

By agreeing and adhering to the terms of this Agreement, You also confirm that You understand Arssi Alliance’s Privacy Policy. To learn more about what we do with your information please review the Arssi Alliance.

By using our Site and/or participating in the Reviews Programs and/or Autoship & Save, you represent and agree that you are at least eighteen (18) years of age or older and are fully able and competent to agree to the terms in this Agreement or any Program terms and conditions. If you are under the age of 18, you are not permitted to use this Site or participate in any Program.

a) Creating and safeguarding your account

To use certain parts of the Site, you may need to create an account ("Account"). You agree to provide us with accurate, complete and updated information for your Account.

If you provide any inaccurate, false, incomplete or outdated information or we in our sole discretion suspect that such information is inaccurate, false, incomplete or outdated, we reserve the right to suspend or terminate your account and prohibit any and all current or future use of the Site or any portion thereof by you.

You are solely responsible for any activity on your Account and for maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your Account. You must immediately notify us using the information in the "Contact Us" section if you know or have any reason to suspect that your Account or password have been stolen, misappropriated or otherwise compromised, or in case of any actual or suspected unauthorized use of your Account.

You agree to be responsible for all charges resulting from the use of your account on the Site including charges resulting from unauthorized use of your account. We are not liable for any loss or damage resulting from your failure to comply with this section.

b) Use of the site

You may use the Site only for lawful purposes and you may not use it in a way that infringes the rights of anyone else or that restricts or inhibits anyone else's enjoyment of the Site.

You agree that you are responsible for your use of and communications on the Site.

You may not

- misuse or tamper with the Site (e.g. hack, introduce viruses, trojans, worms, logic bombs or other technologically harmful material or carry out denial of service attacks etc.)

- use the Site in any way that breaches any applicable local, national, or international law or regulation, , infringes on other's intellectual property rights

- use the Site in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

- use the Site for the purpose of harming or attempting to harm minors in any way;

- to send, knowingly receive, upload, download, use, or re-use any material which does not comply with our user generate content guidelines;

- use any robot, spider, crawlers or other automatic device, process, software or queries that intercepts, "mines," scrapes or otherwise accesses the Site to monitor, extract, copy or collect information or data from or through the Site, or engage in any manual process to do the same; or

- use the Site to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam).

We make no representation that materials contained on the Site or that products described or offered on the Site are appropriate or available for use in jurisdictions outside the Republic of Armenia (RA), or that this Agreement complies with the laws of any other country. Users of the Site outside the Republic of Armenia do so at their own initiative and risk and are responsible for complying with all applicable laws and regulations, and undertake to, at the time of purchase of a product, to ascertain whether the importation of the respective product is allowed by the laws of their country and by the applicable governmental agencies. You agree not to access the Site from any location or territory where its contents are illegal and that you and not us, are responsible for compliance with all applicable laws and regulations.

You are responsible for compliance with all RA or other export and re-export restrictions that may apply to goods.

c) Availability of the site and accessing the site

You are responsible for making all arrangements necessary for you to have access to the Site. You understand that we may terminate or suspend your access to all or part of the Site, with or without notice if we in our reasonable discretion believe you are engaging in any unauthorized activity and/or violating any term or conditions of these Terms of Use, laws or regulations or is harmful to another user or us or our affiliates. Although we aim to offer you the best service possible, the Site, or any content on it, may not always be available or remain uninterrupted. Please note that we may suspend or withdraw or restrict the availability of all or any part of the Site for business and operational reasons without notice (e.g. for repairs, maintenance and/or updates). We will attempt to restore the service as soon as it reasonably can. We will not be liable to you if for any reason the Site is unavailable at any time or for any period. We use reasonable efforts to ensure that the Site is free from viruses and other malicious or harmful content. However, we cannot guarantee that your use of the Site (including any content on it or any Site accessible from it) will not cause damage to your computer or other device. You should use your own virus protection software. We are not liable to any person for any loss or damage they suffer as a result of viruses r other malicious or harmful content that they access from or via the Site.

d) Google Maps/Google Earth

Some areas of the Site implement Google Maps/Google Earth mapping services. Your use of Google Maps/Google Earth is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

With respect to items sold by Arssi Alliance, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. Subject to applicable law, if the correct price of an item sold by Arssi Alliance is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

You agree that we may use your comments, reviews, feedback, suggestions, or questions, and any other submissions disclosed, submitted or offered by you on or through the Website (collectively, "Submissions") without compensation, acknowledgement or payment to you, for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the Site or other products or services. When you make a Submission (other than your personal data which is subject to our Privacy Notice), you grant us a perpetual, worldwide, non-exclusive, royalty-free, transferrable license to use reproduce, distribute, prepare derivative works, and display the Submission in connection with our business, including in order to promote our websites or our business. You also grant us the right to sub-license your content to third parties on the same terms granted by you to us.

By posting or submitting Submissions through the Website, you represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted herein for your Submissions. You agree that your Submissions will not contain material subject to copyright or other proprietary rights, unless you have the necessary permission or are otherwise legally entitled to post the material and to grant us the license described in the preceding paragraph.

Submissions should not include:

- abusive, offensive, or otherwise inappropriate language;

- profanity, blasphemy, spiteful, racist, sexually explicit, sexually gratuitous, or discriminatory comments or content that might be considered to be harassment, abuse or threats against the personal safety or property of others;

- comments about other reviewers or bloggers;

- remarks that repeat criminal accusations, false, defamatory, or misleading statements;

- material which impersonates others or personal information about anyone, including yourself, such as phone numbers, postal addresses, or credit card numbers;

- spam or advertising; or

- HTML code, computer script or Website URLs.

We, in our absolute discretion, reserves the right to not publish any Submission or remove it, take any appropriate action if deemed necessary or remove reviews which do not comply with the rules above.

Please note that the views expressed in Submissions are the opinions of those users and do not represent the views, opinions, beliefs, or values of Arssi Alliance.

By using the Site, you agree that we may send you messages (including text messages) to the specific number(s) you have provided to us with information or questions about your account and/or orders.

You may also have elected to receive marketing and promotional SMS messages (including text messages) from us. Your consent to receive marketing and promotional SMS messages is not required to purchase goods or services. If you have elected to receive SMS marketing messages, we will send you an SMS to confirm your election. Message and data rates may apply and message frequency may vary.

You represent that you are the account holder for the mobile telephone number(s) provided to us. You are responsible for notifying us immediately if you change your mobile telephone number.

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of our control, and we are not responsible or liable for issues arising from them.

Arssi Alliance may use such means of communication described in this section even if you will incur costs to receive such messages, text messages, e-mails or other means, which may occur.

You can stop receiving SMS messages (including text messages) at any time by contacting us.

We may suspend or terminate your receipt of text messages if we believe you are in breach of these terms and conditions. Your receipt of text messages from us is also subject to termination if your mobile telephone service terminates or lapses. We also reserve the right to modify or discontinue, temporarily or permanently, all or any part of the Arssi Alliance Electronic Communications, with or without notice

THE SITE, THE PROGRAMS AND THE INFORMATION CONTAINED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND EXCEPT AS OTHERWISE EXPRESSLY PROVIDED FOR IN THIS AGREEMENT AND ARSSI ALLIANCE EXPRESSLY DISCLAIM ALL WARRANTIES WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

YOU AKNOWLEDGE THAT THAT THE USE OF THE SITE IS AT YOUR SOLE RISK AND ARSSI ALLIANCE DOES NOT WARRANT THAT THE SITE OR ANY PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR FREE OR VIRUS-FREE, NOR DOES IT MAKE ANY WARRANTY AS THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE AND NO INFORMATION OR ADVICE RECEIVED VIA THE SITE SHOULD NOT BE RELIED UPON FOR PERSONAL, MEDICAL, LEGAL OR FINANCIAL DECISIONS AND YOU SHOULD CONSULT AN APPROPRIATE PROFESSIONAL FOR SPECIFIC ADVICE TAILORED TO YOUR SITUATION.

IN NO EVENT SHALL ARSSI ALLIANCE ENTITIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF GOOD WILL, LOSS OF USE, LOSS OF DATA, COST OF PROCURING SUBSTITUTE GOODS, SERVICES OR INFORMATION, LITIGATION OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ARSSI ALLIANCE ENTITIES ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS OF LIABILITY SET FORTH HEREIN ARE PERMITTED BY APPLICABLE LAW TO THE MAXIMUM EXTENT AND ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE ARRANGEMENT BETWEEN ARSSI ALLIANCE AND YOU. THE PRODUCTS, INFORMATION, PROGRAMS AND SERVICES OFFERED ON AND THROUGH THE SITE WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. FOR THE CUSTOMER, THE MAXIMUM LIABILITY OF ARSSI ALLIANCE ENTITIES SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR ANY PRODUCT, INFORMATION OR SERVICE PURCHASED BY YOU FROM ARSSI ALLIANCE ON THE SITE.

You agree to indemnify, defend and hold us, our related companies and each of our and their respective directors, officers, employees, agents, affiliates, third party information providers, licensors, contractors and others involved in the delivery of products, services or information through the Site (collectively, "Indemnified Parties"), from and against all losses, expenses, costs and damages including attorney's fees resulting from, in connection with, or relating to your use or inability to use the Site, participation in any Program, products or services purchased or obtained by You in connection with the Site, any Site postings or activity related to your account made by You or another person, Your violation of any terms of this Agreement, Your violation of any rights of a third party, or Your violation of any applicable laws, rules or regulations. You agree to cooperate as fully as reasonably required in the defense of any such claim. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you pursuant to his section, in which event you will still be required to indemnify us for the attorneys’ fees and expenses in addition to any losses, claims, damages and liabilities incurred by us as a result of this claim. You shall not in any event settle any matter without prior written consent of Arssi Alliance.

We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it including but not limited the Programs design, text, graphics, sounds, pictures, software and other files, the trademarks, service marks, trade dress, trade names, and logos (collectively, "Materials and Marks"), contained on the Site. In addition all page headers, custom graphics and custom icons are Marks of Arssi Alliance.

Materials and Marks are our property and are subject to and protected by Republic of Armenia and international copyright or other intellectual property laws and rights.

The Services and the Site may only be used for the intended purpose for which such Site and Programs are being made available.

Except as may be otherwise indicated in specific documents within the Site, Arssi Alliance grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Materials and Marks, for personal, informational, and noncommercial purposes only (the "License"). You agree not to copy, modify, use, distribute, transmit, republish, sell, resell or exploit, for any purpose, any portion of the Site, Materials or Marks other than as expressly authorized by Arssi Alliance in writing. This License remains in effect until this Agreement is terminated by either you or us in accordance with this Agreement. Any unauthorized use of the Materials or Marks shall be grounds for termination of the License. All rights not expressly granted herein are reserved by Arssi Alliance and its licensors.

This Agreement constitutes the only Agreement between us and you with respect to the subject matter of this Agreement. This Agreement supersedes all prior or contemporaneous Agreements, representations, warranties and understandings, written or oral, with respect to the subject matter of this Agreement.

If any provision of these Terms of Use is held to be invalid or unenforceable, that provision shall be construed consistent with applicable law, and the remaining provisions shall be enforced.

All questions concerning the construction, validity, enforcement and interpretation of this Agreement shall be governed by and construed in accordance with the domestic laws of the Republic Of Armenia, without giving effect to any choice of law or conflict of law.

Either party asserting a dispute shall first try in good faith to resolve it by providing written notice to the other party describing the facts and circumstances (including any relevant documentation) and allowing the receiving party 30 days in which to respond.

Either Party may exercise the right to apply to court by providing the other Party with written notice of any and all claims forming the basis of such right in sufficient detail to inform the other Party of the substance of such claims.

The Parties are entitled to representation by an attorney or other representative of their choosing, and at their own costs. Each Party shall pay its own attorney fees.

You may not assign this Agreement to the third party without our prior written consent except the cases provided by applicable law. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns.

Our failure to enforce any provision of these Terms of Use shall not constitute a waiver of that or any other provision.

Regardless of any statute or law to the contrary, you must file any claim or action related to use of the Site or this Agreement within one year after such claim or action accrued. Otherwise, you will waive the claim or action.

In case you received the product from the Site damaged (not including packaging) or validity date is expired you have the right to demand refund or exchange of product during 3 days after receiving the product.

To be eligible for an exchange or refund, your product needs to have the receipt or proof of purchase and you need to contact us and send evidence (photo, video) via email of damaged product. After receiving evidence we will inspect them and notify you about the result during 2 days.

After inspection of evidence we will make decision and contact you regarding exchange of product or refund.

We will make exchange of product at our expense during 30 days after you return the damaged product you received.

In case of refund we will initiate a refund to your credit card (or original method of payment). You will receive the credit within a certain amount of days, depending on your card issuer’s policies.

If you contact us later than 3 days after receiving the product, you cannot demand refund or exchange of product and the product will be considered accepted.
